Terms and Conditions

The online store provides the content available on the website www.astrastones.com and offers goods/services in accordance with the Terms of Use set out below.  The online store www.astrastones.com  is a structural unit of Astras Vītola, self-employed person, reg. no. 21065911802, Beberbeķu iela 90, Riga, LV 1029, registered with the State Revenue Service of the Republic of Latvia.

1. General provisions

If the consumer purchases goods/services via the website, such mutual agreement is considered a distance contract and is subject to the legal provisions of the Republic of Latvia governing distance contracts, including but not limited to the Consumer Rights Protection Law of the Republic of Latvia, the Cabinet of Ministers Regulations “Regulations on Distance Contracts”, etc.  The online store has the right at any time to unilaterally change the content and terms of use of the website www.astrastones.com. Such changes take effect after they are published online at www.astrastones.com.  From the moment you start using the website www.astrastones.com or perform any activities on the said website, it will be considered that you have familiarized yourself with the terms in force at the time of use and will comply with them. Each website user has the duty to regularly review the terms in order to be timely informed about changes made to them. If you do not agree to the terms, you are prohibited from using the website.  Users of the website www.astrastones.com have the right to use the opportunities and services offered therein at the price in force at the time the relevant service is offered. A. Vītola has the right at any time, at her discretion, to change the prices indicated on the website www.astrastones.com and/or create new paid services. To become a registered user of the online store, you must follow the registration procedure specified on the website www.astrastones.com.  Each registered user of the online store has the duty not to disclose their access data to other persons. If actions are performed on the website www.astrastones.com using a registered user profile (incl. goods and/or services are purchased) by using the correct username and password, it is considered that the actions in the relevant profile were performed by the registered user themself.  If requesting A. Vītola or a person representing her to make changes to a registered order that is incomplete, please note that changes can be requested only by writing an e-mail to [email protected] from the e-mail address indicated in the order, or by contacting A. Vītola by calling from the phone number indicated in the order at 29255446.  Use of the website www.astrastones.com does not grant any ownership rights to its content to which access is granted. It is prohibited to use the content of information posted on the website www.astrastones.com unless you have permission from the owner of this content or other permission in accordance with applicable legal acts of the Republic of Latvia. These terms do not grant the right to use any text, trademark, logo, or photograph included on the website www.astrastones.com. It is also prohibited to remove, make illegible, or change notices visible on the website.  The website www.astrastones.com displays product content and descriptions and other information that is the property of A. Vītola.  In connection with the services used, A. Vītola is entitled to send notifications, reminders about started but unfinished services, and other information to the provided electronic e-mail address with the aim of improving the quality of service provision. A. Vītola is also entitled to send information about news, promotions, and discounts of www.astrastones.com and A. Vītola’s cooperation partners.

2. Making purchases

The prices and specifications of products sold in the online store are indicated next to the products, and in some cases additional information is available in the product photo gallery. Although the photographs of the goods indicated in the online store are taken by photographing the respective goods, individual goods may differ slightly from those shown in the photograph, because each item purchasable in the online store is a unique handmade product; therefore, in the legal sense, the photographs are for illustrative purposes.

To place an order, add the desired products to the shopping cart. Fill in all required fields and choose the most suitable delivery method. The total cost of the order including delivery is then displayed on the screen. Make payment to complete the order.

3. Payment terms

The settlement currency on the website is euro. Purchases can be paid for by choosing the following payment methods provided by the payment platform makecommerce.lv , Maksekeskus AS:

  • Latvian internet bank payments: Swedbank, SEB, Citadele and Luminor

  • Estonian internet bank payments: Swedbank, SEB, Luminor

  • Lithuanian internet bank payments: Swedbank, SEB and Luminor

  • Finnish internet bank payments: Aktia, Ålandsbanken, Danske, Handelsbanken, Nordea, Oma Säästopankki, Pohjola, POP Pankki, S-Pankki, Säästopankki

  • Visa/Mastercard card payments

  • Bank transfer to A. Vītola’s account from any other bank account based on the order invoice issued by the online store www.astrastones.com, indicating the order number in the payment purpose. After payment of the order invoice, it is possible to receive an electronic final invoice.

When using the internet bank payment method, confirm the order and click the button “Return to merchant”.

Personal data required to make payments are transferred to the licensed payment institution Maksekeskus AS.

The contract enters into force upon successful payment to the online store’s bank account. If for any reason it will not be possible to fulfill the order, the Buyer will be informed and the paid amount will be refunded as soon as possible, but no later than within 14 days after receipt of the notice.

4. Delivery terms

Goods are delivered to the following European Union countries: Latvia, Lithuania, Estonia, Austria, Belgium, Bulgaria, Czechia, Denmark, France, Greece, Croatia, Estonia, Ireland, Italy, Cyprus, Luxembourg, Malta, Netherlands, Norway, Poland, Portugal, Romania, Slovakia, Slovenia, Finland, Spain, Hungary, Germany, Sweden, as well as to the following countries outside the European Union: United Kingdom, USA, Iceland. Goods can also be shipped to other countries not mentioned above. For delivery costs to a country not included in the above list, please write to [email protected].

Purchased goods are delivered using: SIA “Omniva” parcel lockers (in Latvia, Lithuania, Estonia) or other licensed courier postal services (for shipments outside Latvia, Lithuania, Estonia) and courier services.

Individual collection of goods is possible at A. Vītola’s legal address or at a mutually agreed meeting place, by agreeing on the collection time in advance in writing or by phone.

All duties and taxes that must be paid to receive the shipment at the delivery destination must be covered by the Buyer. Delivery costs are displayed before order confirmation.  Purchased goods are prepared for dispatch and shipped within three business days after full payment of the order. If the order is not paid within 5 business days, it is canceled. Purchased goods are delivered to the address indicated by the Buyer within 1 to 30 business days depending on the workload of the delivery service provider.

5. Right of withdrawal

The Buyer  has the right to withdraw from an unused product within 14 calendar days, except for goods from the store section “Earrings” for hygiene reasons. When returning the purchased product, the Buyer must present a document confirming the purchase. The online store undertakes to refund the money within 10 business days. If the goods are used inappropriately or damaged, handled carelessly during use or instructions are not followed, if the original packaging of the goods is lost, or if the packaging is significantly damaged, the online store has the right to reduce the refundable amount in accordance with the decrease in the value of the goods. The right of withdrawal does not apply if the Buyer is a legal entity. The Buyer covers the costs of returning the goods, except in cases where the reason for the return is that the goods do not correspond to the order (for example, an incorrect or damaged product).

The Buyer’s obligation is, without delay but no later than within 14 days after sending the withdrawal form to the online store, to return the Goods to the Seller. After receiving the returned goods, the online store shall immediately, but no later than within 14 days, refund all payments received from the buyer on the basis of the distance contract.

The Seller has the right to withhold the refund until it has received the Goods from the Buyer or proof of return of the goods. If the buyer has chosen a shipping method other than the cheapest shipping method offered by the online store, the online store is not obliged to reimburse the excess shipping costs.

The online store is not liable for delays in the performance of obligations or non-performance, or other non-performance that has arisen due to circumstances and obstacles beyond the reasonable control of the online store.

The online store reserves the right to refuse to sell goods and to demand the return of goods from the Buyer if the price indicated in the online store is significantly lower than its market price due to an error.

6. Consumer rights regarding goods not conforming to the contract

The online store is responsible for non-conformity of the goods sold to the Buyer with the terms of the contract or for defects that arise within 6 months after the day of delivery of the goods to the customer, or that existed at the time of delivery, if such an assumption is not contrary to the characteristics of the item or the defect. The Buyer must inform the Seller about the non-conformity of the goods immediately, within 2 months after its discovery, i.e., submit a complaint. The Buyer may submit a complaint by contacting the online store by writing an e-mail to  [email protected].

The online store is not responsible for defects that arise after delivery of the goods to the Buyer. If the purchased goods have defects for which the Seller is responsible, the Buyer has the right to request that the defects be remedied or that the goods be exchanged for new goods free of charge.

If the goods cannot be repaired or replaced, the Seller returns to the Buyer all payments provided for in the distance contract. The Seller shall provide a written response to the consumer complaint within 15 days.

7. Processing of the Buyer’s personal data

The online store processes only the personal data that the buyer has entered when ordering goods, such as name, surname, e-mail, etc.

The online store transfers personal data to the transport service provider(s) in order to ensure delivery of the goods.

If you have clearly agreed to receive our marketing communications, including news, we may from time to time contact you by sending information about our services and the latest offers. For this purpose, we may process your e-mail address that you provide when subscribing to marketing communications. The Buyer has the option to opt out of marketing communications by notifying us by writing to [email protected].

8. Dispute resolution procedure

In matters not covered by these terms and conditions, the Buyer and the Seller undertake to comply with the regulatory enactments in force in the Republic of Latvia.

The parties shall resolve all disputes arising between the Seller and the Buyer through mutual negotiations or correspondence. If the dispute cannot be resolved through negotiations or correspondence, the parties shall resolve the dispute in the court of the Republic of Latvia, observing the regulatory enactments of the Republic of Latvia. Disputes between the Buyer (consumer) and the Seller may be submitted for resolution to the Consumer Rights Protection Centre or to the court of the Republic of Latvia.

The Buyer also has the right to apply to dispute resolution bodies of the European Union.
